S.F. Superior Court Judge Refuses
To Put Green Party Congressional
Candidate on November Ballot

SAN FRANCISCO - A San Francisco Superior Court judge late Wednesday ruled -
after more than 3 months of delays - that Green Party congressional
candidate Terry Baum cannot have her name placed on the November ballot in
the 8th District, a seat currently held by Nancy Pelosi (D).

The Green Party has called an important news conference for Thursday, 1:30
p.m. at the Green Party Campaign Office (1028 A Howard St.)

Baum is expected to comment on the ruling and an anticipated appeal.
Details of Judge Ronald E. Quidachay’s decision were not available as of
late Wednesday, but he noted in a previous hearing that the case was “like
the hanging chad in Florida” where voter intent was clear but the votes
were not counted.

At issue are several hundreds write-in votes for Baum that were found, and
counted by the San Francisco Department of Elections. The DOE qualified
Baum as the winner of the Green nomination, but then later refused to
validate the disputed votes because people wrote in Baum’s name but did not
fill in a small arrow - in effect, the “hanging chad.”

Baum has argued that the state code cited by DOE is not applicable, and
unconstitutional.

Baum, a lesbian playwright in San Francisco and a staunch anti-war and
pro-civil rights activist, has built an army of campaign backers who decry
Pelosi’s vote for the Patriot Act and support for sending even more troops
to Iraq.
